    I believe the changes that the Dpt of Justice is making are going to hurt the sellers, because they will have less buyers, because some buyers cannot afford a down payment, closing costs & a Realtor commission, so they will drop out and less buyers mean less money in the seller's pocket. Our poor veteran buyers will be hurt. I also believe that Buyers will be hurt by this, because they are going to have to commit to a Realtor immediately before looking at a property. How do you even know if you are going to trust & like that Realtor. Before these rules, buyers could look at a property and not have to commit to a Realtor until they got to know them. Buyers will also have to pay more money with new rules. Sorry, I think I was suppose to say something positive, well here goes, maybe the listing agent will be able to double dip more, meaning list & sell it themselves. Which is also not a good thing :(, sorry, tried to say something, but I've got nothing and I have done this job for 32 yrs.

    I’m an agent in FL. This is a ridiculous and confusing outcome that is going to hurt buyers who already have a tough time buying a house. Agent’s commission has always been negotiable and transparent. This is going to create so much more confusion for everyone involved.

    One thing you didn't mention about the buyer agreement...the term of the agreement can last till a certain date or for that particular property AND more importantly...you can terminate the agreement BUT you have to issue a statement (letter) explaining why you are terminating the agreement.

    What would prevent a buyer from just going directly to the selling/listing agent to view a home and not even use a buying agent/broker? I mean with apps like Zillow you can basically already see what is available and a general idea of what the property is.... just curious.

      That has always been an option for buyers. The risk is the seller, and particularly the sellers agent have a fiduciary duty and responsibility to protect the sellers interest only. Real estate transactions are chalked full of if-this-then-that-or-this situations. Between timelines, inspections, venders, and negotiations, most buyers do not have experience to know what to do when issues arise.

      I've bought and sold a couple houses without an agent. All i did was hire a real estate attorney and they handled all the contracts/paperwork/closing. It was easy and cheap. Of course you want to go through any offer/contract yourself just to make sure no one has snuck anything in. One example is a buying agent added a line that if I pull out of the agreement, I still pay their commission. I of course crossed out that line from the contract. I wasn't offering a commission anyways to any agents. But they tried a sneaky way of adding it into the contract. But to answer your question, you don't need a buying agent. You do (or should) need a real estate attorney.

      @@TheK9Shepherd That's the way it used to be done. And still is. I sold my house in '20 and there were no agents involved and we are buying one next week with no agents involved. Just a lawyer to make sure we do the correct forms. A few hundred bucks. Plus title insurance and filing fees.

    How close is Loop access to Tanque Verde by bike? Are there bike lanes on the roads to access the Loop from TV? Thanks !

      To get on the LOOP from TV Valley is about 4 miles. You can take Tanque Verde which has a bike land to access The Loop.

      As Tucson gets hot, people go on vacation to escape the heat and winter visitors are gone the Tucson housing market slows down for a couple of months. Good question. Thanks for watching.

    Hello Tyler, thank you for this very informative video!! We just completed a 2 week camping trip in Tucson to 1) get out of our lingering Ouray, Colorado winter and 2) check out the greater Tucson area to determine if we would want to consider it as a place to move. We are just below 8000 feet msl, and we live on a 10% sloped road that is icy 5 months per year. My wife had 2 major surgeries this year; and I have a somewhat decrepit retired army body (but still actively can walk). Anyways, we are considering the out years and looking to relocate to a better location to get at. At this point, I feel like Tucson is a win for us! As my wife said....we should "date" Tucson this year and look to maybe make the move next year. To answer your specific questions-- (my disclaimer is I am not from or really familiar with the specific Tucson market) It is proving to predict exactly what interest rates will do. At the end of 2023, it was expected to see some rate drops already by this time in the year. And then inflation has now stayed around longer than expected. So....my guess is the very last calendar quarter of the year we may see 1 rate drop; 2 if we are super lucky. And then it gets complicated when you incorporate that it is an election year. That usually triggers artificial euphoric falsities (that may be a George Bush word). Since I may be a house buyer in Tucson next spring or summer, my hope is your area has a single digit growth. Of course, price drops would be better for us, specifically. I feel it is good for the overall area to have a steady single digit increase.

      It depends on the time of the year. The "goat heads" become an issue in the fall when the tumble weeds are dried up and the wind blows them into The LOOP or on the road. In the spring not an issue. I never run Gator Skins.

    Hum. The fact is that the two parties to the transaction (i.e. the buyer and the seller) always paid the cost of the transaction which includes the realtors fees. But the realtor fees were built into the transaction price, which got rolled in the mortgage. It gives rise to a fundamental conflict of interest, which is now being addressed by getting a mandatory buyer mandate in place. It is too early to tell how the pieces will fall into place. But, I would caution realtors representing buyers to call the seller realtor to negotiate commissions, unless it is authorized explicitly in the buyer mandate. Also, if I was a realtor representing a buyer, I would insist to get my final commission amount formally approved in writing by the buyer prior to closing.

    I have always enjoyed your analysis. In this case you have obvious personal motivation. Buying and selling houses is not rocket science. There is very little transparency in the current system. Hopefully the additional transparency going forward will make the process friendlier to both buyers and sellers.

    No matter how you split the commission the buyer is paying it. If the seller agrees to the co-op it's included in the price which the buyer pays. If the seller refuses to pay then the buyer pays it separately. Either way the buyer's paying.

    I believe the custom will shift to buyers paying their agent. Agents will need to get used to making a lot less money on the buy side. As an experienced buyer, I just need an agent to let me into a property because seller's agents will refuse to give me the keycode. I can write my own contracts, do my own research, and bring in my own inspector. Thus, if I am still forced to work with an agent and the seller is not paying them, they will be paid at a fair hourly rate for their services and they will submit billable hours to me.

    I think a lot of FTHB will try to educate themselves on the process and contract writing and go at it alone since they can see the home listings/address on public MLS.

      Time will tell how it all plays out. There are many moving parts to buying and selling a home. Getting a home under contract is the easy part. The work begins once a buyer and seller are under contract.
